Terms of Service — Sukanya Online Thai Food

Effective date: August 16, 2026

These Terms of Service ("Terms") govern your use of sukanyaonline.ca and any purchase you make from Sukanya Online Thai Food ("we", "us", "our"). By visiting the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

2. What we sell

We sell imported Thai and Southeast Asian groceries, seasonings, curry pastes, noodles, snacks, kitchenware, and household items, shipped from Kingston, Ontario across Canada and the United States. Our storefront runs on Shopify.

3. Eligibility

You must be at least the age of majority in your province or state to buy from us (18 or 19 in Canada depending on your province; 18 in most US states). By placing an order, you confirm that you meet this requirement and that all information you provide is accurate.

4. Your account

You can shop as a guest or create an account. If you create an account, you are responsible for keeping your password safe and for any activity under your account. Tell us right away if you notice unauthorized use.

5. Products and availability

We try to keep product photos, descriptions, and ingredient lists accurate, but small differences happen — suppliers repackage, labels change, and colours vary between screens. Where the manufacturer's label differs from our website, the manufacturer's label controls. We may correct errors and update product information at any time.

We may limit or refuse orders at our discretion, including where an item is out of stock, priced incorrectly, or ordered in quantities that appear commercial when we sell for personal consumption.

6. Allergens and food safety

Many products we sell are manufactured in facilities that also process peanuts, tree nuts, shellfish, fish, soy, wheat, gluten, dairy, egg, sesame, and sulphites. Read every product's ingredient list and manufacturer allergen statement before you buy or consume. If you have a known allergy or medical condition, do not rely on our website copy alone — the manufacturer's label is the authoritative source.

We do not make health claims about the products we sell. Nothing on our site is medical advice.

7. Prices, currency, and taxes

All prices are shown in Canadian dollars (CAD) unless labelled otherwise. Applicable Canadian sales taxes (GST/HST/PST/QST) are calculated at checkout based on your shipping address. For US orders, US state and local sales taxes may be calculated at checkout where required by law. Any customs duties or import fees on orders shipped outside Canada are the buyer's responsibility.

Prices may change without notice. We honour the price shown at the time you place the order.

8. Orders and order acceptance

Placing an order is an offer to buy at the prices and terms shown. We accept your offer when we send you an order confirmation by email. Until then, we may cancel or amend the order. If we cancel an order after payment, we refund the payment method used.

Order changes and cancellations are only possible before the order ships. Email Sukanya_Online@hotmail.com as soon as possible; we will do our best but cannot guarantee changes once fulfillment has started.

9. Payment

We accept credit and debit cards, Apple Pay, Google Pay, Shop Pay, and PayPal through our checkout. Payments are processed by our payment providers — we do not store your full card number. If your payment fails or is later reversed, we may cancel the order and take reasonable steps to recover any product already shipped.

10. Shipping

Shipping terms — carriers, costs, timelines, address responsibility, international duties — are described in our Shipping Policy. That policy is part of these Terms.

11. Returns and refunds

Return and refund terms — the food/perishable final-sale rule, the 48-hour window for damaged or incorrect items, the 30-day return for unopened non-food items, and how refunds are issued — are described in our Refund Policy. That policy is part of these Terms.

12. Prohibited uses

You may not use our site or products:

  • For any unlawful purpose or in violation of any Canadian federal, provincial, US federal, state, or local law
  • To resell products commercially without our written permission
  • To harvest information from other customers, scrape site data, or interfere with the site's operation
  • To submit false or misleading information, or to impersonate anyone
  • To infringe our intellectual property or that of any third party
  • To transmit viruses, malware, or any code intended to disrupt the site or the Service
  • To harass, abuse, or threaten any person

We may terminate your access, refuse orders, or take other reasonable steps if you breach these Terms.

13. Intellectual property

The site's content — text, images, logos, layout, and code — is owned by us or licensed to us, and is protected by Canadian and international copyright and trademark law. You may view and use the site to shop with us; you may not copy, reproduce, or redistribute site content without our written permission. Product names and logos belong to their respective manufacturers.

14. Third-party links and services

We link to third-party sites and use third-party services (Shopify, payment processors, shipping carriers, Google, Meta). We are not responsible for the content, privacy practices, or terms of third-party sites and services. Read their own policies before you engage with them.

15. User content

If you send us reviews, feedback, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, copy, and display that content in connection with our business (for example, showing your review on the product page). You represent that the content is yours to share and does not infringe anyone else's rights. We may edit or remove content at our discretion.

16. Disclaimers

The site and the products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties — express, implied, or statutory — except those that cannot be excluded under Canadian or applicable US state consumer-protection law. Canadian consumer-protection statutes (including the Consumer Protection Act, 2002 in Ontario) grant certain rights that these Terms do not limit.

We do not warrant that the site will be uninterrupted, error-free, or free of viruses. We do not guarantee that products will meet your specific expectations; the products we sell are groceries and household items intended for ordinary consumer use.

17. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of your use of the site or a purchase is limited to the amount you paid for the order that gave rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Some jurisdictions do not allow the limitation or exclusion of certain damages; where that applies to you, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.

18. Indemnification

You agree to indemnify and hold us and our owner harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. Any dispute is to be brought in the courts of Ontario, and you consent to that jurisdiction. If you live in a Canadian province or a US state that grants you the right to bring a claim in your local courts, these Terms do not override that right.

20. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of the page shows when the current version took effect. Continued use of the site after we post an update means you accept the updated Terms. If a change is material, we will make reasonable efforts to notify customers with active accounts by email.

21. Severability

If any provision of these Terms is found to be unenforceable, that provision is severed and the rest remain in effect.

22. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and us for your use of the site and any order you place.
